1. Acceptance of these terms
These Terms of Use ("Terms") govern your access to and use of the Lucenne Medical Coding website, learning materials, AI-guided coaching features, and related services (collectively, the "Service"). Your use of the Service is also subject to our Privacy Policy. If you do not agree to these Terms, do not use the Service.
2. Eligibility and authorized use
You must be able to form a binding agreement under applicable law to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms and to permit authorized users to access the Service under those terms.
3. Educational purpose and no operational reliance
The Service is provided solely for education, training, evaluation, and skill development in medical coding. It is not a substitute for official coding resources, payer policies, employer policies, compliance review, professional certification guidance, legal advice, medical advice, or professional judgment.
Outputs, recommendations, scoring, feedback, and AI-generated content may be incomplete, inaccurate, or outdated. You are solely responsible for independently reviewing and verifying any output before using it in connection with billing, reimbursement, audit response, compliance decisions, employment evaluations, or production coding workflows.
4. Use restrictions
You may use the Service only for lawful, educational, and training purposes. You agree not to:
- Copy, distribute, or create derivative works from the Service or its content without explicit written permission from Lucenne Medical Coding.
- Reverse engineer, decompile, or attempt to extract source code or underlying models.
- Interfere with or disrupt the Service, including through automated scraping or excessive requests.
- Use the Service to provide professional medical, legal, or financial advice.
- Use the Service or its outputs as the sole basis for coding, billing, reimbursement, compliance, audit, or employment decisions.
- Submit protected health information, patient identifiers, medical records, or other regulated health data through the Service.
- Upload or share confidential employer, payer, client, or institutional records unless you are expressly authorized to do so.
- Upload or share licensed codebooks, payer materials, or other third-party proprietary content unless you have the right to do so.
Lucenne may suspend or terminate access for suspected misuse and may seek injunctive relief, damages, and any other remedies available at law or in equity.
5. Intellectual property
All content, features, and functionality of the Service are owned by Lucenne or its licensors and are protected by intellectual property laws. Except for the limited license to use the Service, no rights are granted to you.
6. Submissions and feedback
If you submit information, feedback, or other materials through the Service, you grant Lucenne a non-exclusive, worldwide, royalty-free license to use that material to operate, maintain, improve, and secure the Service. You represent that your submissions do not infringe the rights of others and do not contain information you are prohibited from sharing under these Terms.
7. Privacy and data practices
Personal information and usage data are handled as described in our Privacy Policy. By submitting a form or otherwise providing information through the Service, you acknowledge that Lucenne may use that information to respond to you, evaluate requests, operate the Service, and improve the user experience.
8. Subscription plans, cancellations, and refunds
If you purchase a subscription, online course, or other paid offering from Lucenne Medical Coding, the pricing, billing cadence, and plan details presented at checkout are incorporated into these Terms.
Unless a different refund right is required by applicable law or expressly stated at checkout, you may cancel and request a full refund within three (3) calendar days after the date of purchase, provided that you have not accessed, viewed, or partially completed any online course or subscription content associated with that purchase. Refunds will not be issued for any course or subscription content that has been accessed, viewed, or partially completed.
Lucenne Medical Coding will review refund requests and, if approved, process the refund within 15 business days. Lucenne may deny refund requests that do not satisfy these conditions or that involve misuse of the Service, bad-faith payment disputes, or violations of these Terms.
9. Third-party services
The Service may link to third-party sites or services, including payment or plan pages. Lucenne is not responsible for third-party content or policies, and your use of those services is governed by their terms.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis. It is intended for educational and training purposes only and does not constitute professional advice or authoritative coding determinations. Lucenne does not warrant that the Service will be uninterrupted, secure, error-free, or suitable for any particular certification, employment, reimbursement, or compliance outcome.
11. Limitation of liability
To the maximum extent permitted by law, Lucenne will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service. If liability is found, Lucenne's total liability will not exceed amounts paid by you to Lucenne for the Service in the 12 months prior to the claim.
12. Indemnification
You agree to indemnify and hold Lucenne harmless from any claims, liabilities, damages, and expenses arising out of your use of the Service or violation of these Terms.
13. Changes, suspension, and termination
Lucenne may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. Lucenne may suspend, limit, or terminate access to the Service at any time for misuse, security concerns, legal compliance, or any other reasonable business purpose.
14. Governing law and venue
These Terms are governed by applicable laws in the jurisdiction where Lucenne is headquartered, without regard to conflict of law principles. The state or federal courts located in that jurisdiction will have exclusive jurisdiction over disputes arising from these Terms or the Service, except that Lucenne may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
15. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Lucenne's failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without Lucenne's prior written consent. Lucenne will not be liable for delay or failure caused by events beyond its reasonable control. Provisions that by their nature should survive termination will survive, including those related to intellectual property, disclaimers, limitation of liability, indemnification, and governing law. These Terms, together with the Privacy Policy, are the entire agreement between you and Lucenne regarding the Service.
